| LAW OF GEORGIA ON SOCIAL PROTECTION GUARANTEES OF THE MEMBERS OF THE CONSTITUTIONAL COURT
Article 1. In accordance with paragraph 3, Article 4 of the Law of Georgia of January 31, 1996 on the “Constitutional Court of Georgia”, to ensure the independence of the member of the Constitutional Court, the State shall have the duty of creation appropriate living and working conditions for him/her. The Constitutional Court expenses shall be provided for in the State budget by a separate article upon the submission of the President of the Constitutional Court.
Article 2. 1. Monthly salary from the work remuneration of the member of the Constitutional Court of Georgia shall be detrained by the Law. 2. The official salary of the Vice-Presidents and secretary of the Constitutional Court shall not be less than 90 and that of the salary of President of the Constitutional Court, and salary of the member – less then 85 percent. 3. Monthly addition to the salary shall be given to the President of the Constitutional Court and shall not be less than 90 percent of his/her salary. 4. The amount of the monthly addition to the salary of the President of the Constitutional Court shall be determined by the Plenum of the Constitutional Court in the frames of finances allocated for the Constitutional Court by the state budget. 5. Monthly addition to the salary shall be given to the Vice-Presidents, secretary and members of the Constitutional Court and shall not be less than 50 percent of the monthly addition to the salary if the President of the Constitutional Court. Article 3 The President of the Constitutional Court, Vice-Presidents of the Con¬stitutional Court, the members of the Constitutional Court shall be also given an addition to the salary for the qualification grades and the years served ac-cording to the procedures and norms established by the Georgian legislation. The procedures for granting the qualification grades shall be determined by law.
Article 4 The Constitutional Court shall be provided with representative allowances for the representative expenses according to the procedures provided for by the legislation.
Article 5 A member of the Constitutional Court enjoys a paid vacation annually, the length of which shall be 45 days; before taking vacations a member of the Constitutional Court shall be given material aid equal to the amount of his/her 2 months salary.
Article 6 Privileges of the members of the Constitutional Court shall be determined by the Georgian legislation. (Article acquired a new wording on 01.01.2005)
Article 7 During an official business trip the President and Vice-Presidents of the Constitutional Court shall be given an addition to the salary, accordingly 50, 40 or 35 per cent of per diem.
Article 8 During the entire term of his/her authority reduction of the salary and other material privileges of the member of the Constitutional Court shall be prohibited.
Article 9 1. The President, Vice-Presidents, Secretary and members of the Constitutional Court (hereinafter member of the Constitutional Court) shall be granted a lifetime pension which shall be equal to the amount of their full salary if: a) the term of their authority has expired; b) not earlier than 5 years after the designation to the Constitutional Court a member of the Constitutional Court has resigned from the office and he/she has at least 20 years of length of service. 2. In case of death of a member or a former member of the Constitutional Court or when she/he is declared to be missing his/her spouse and children dependent on him/her before they reach of 18 years shall be jointly granted a pension equal to the pension or salary of the dead person. 3. If as a result of attack in connection of his/her activity as a member or former member of the Constitutional Court he/she has died, his/her spouse and children are granted either disposable material aid equal to the amount of his/her 10 years salary or granted pension equal to the amount of the pension or salary of a member or a former member of the Constitutional Court. 4. A member of the Constitutional Court who was disabled as a result of circumstances provided for in paragraph 3 of this Article shall be given aid: a) in case of partial loss of ability to work – equal to the amount of his /her 1 year salary; b) in case of complete loss of his/her ability to work – equal to the amount of his/ her 5 years salary. 5. The amount of pension of the former member of the Constitutional Court shall be subject to modifications in accordance with the salary modifications of a member of the Constitutional Court. 6. If a former member of the Constitutional Court works, the pension and salary paid for the new work shall be fully given. 7. (removed on 13.08.2004) 8. This law shall be applied to all the members of the Constitutional Court appointed before the enforcement of this Law.
